18 U.S.C. § 2257 Compliance

0. Platform / Producer Status (Important Notice)

NaughtyBounty is a platform that may host content submitted by independent third-party users (“Creators”). Unless explicitly stated otherwise for specific NaughtyBounty-produced content, NaughtyBounty is not the “primary producer” of third-party content uploaded by Creators. Each Creator is responsible for ensuring that all visual depictions they upload comply with applicable law, including age-verification, record-keeping, and consent requirements for all Performers appearing in their content.

NaughtyBounty maintains and enforces policies requiring that, for content falling within the scope of applicable record-keeping laws, all Performers are verified to be at least 18 years of age at the time the content was created, and that required consent documentation is obtained and retained by the appropriate party(ies).

1. Compliance Statement

NaughtyBounty is fully compliant with the record-keeping requirements of 18 U.S.C. § 2257 and 18 U.S.C. § 2257A, as well as the implementing regulations set forth in 28 C.F.R. Part 75, to the extent applicable to NaughtyBounty as the operator of this website and with respect to any content for which NaughtyBounty is deemed the “primary producer” under applicable law.

For any content on this website that constitutes actual or simulated sexually explicit conduct under applicable law, all models, actors, and other individuals ("Performers") were at least 18 years of age at the time of creation.

2. Definitions

For the purposes of this statement, "Sexually Explicit Conduct" is defined in accordance with 18 U.S.C. § 2256(2) as:

• Sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;
• Bestiality;
• Masturbation;
• Sadomasochistic abuse;
• Lascivious exhibition of the genitals or pubic area.

3. Record Keeping Requirements

For content uploaded by independent third-party Creators, the records required by 18 U.S.C. § 2257 are maintained by the applicable Creator(s) and/or other applicable primary producer(s) for the content, and such records are required to be properly indexed and cross-referenced to the specific content.

Where NaughtyBounty is the primary producer of specific content (if any), or where a Creator has designated NaughtyBounty (by written agreement) as the custodian of records for that Creator’s content, the following records are maintained on file for every Performer depicted:

• Identity:A copy of a government-issued identification document bearing the Performer's picture and date of birth.
• Names:The Performer's legal name and any stage names used.
• Dates: The date of production of the content (if known) or date of upload.

These records are cross-referenced with the content and maintained for the period required by applicable federal law and regulations.

NaughtyBounty prohibits the upload of any content involving minors or any material that violates applicable law. NaughtyBounty will remove content and may suspend or terminate accounts for violations of its policies, and may cooperate with lawful requests from authorities.

4. Custodian of Records

For content for which NaughtyBounty is the primary producer and/or for which NaughtyBounty has been designated as the custodian of records, the records required by 18 U.S.C. § 2257 are kept by the following Custodian of Records:

Records will be made available to authorized government officials for inspection at the address listed above during normal business hours, as required by applicable law.

5. Third-Party / Creator Content

With respect to depictions uploaded by independent third-party Creators, the applicable Creator(s) and/or other applicable primary producer(s) are responsible for maintaining the records required by 18 U.S.C. § 2257 and making them available as required by law. NaughtyBounty may require Creators to provide proof of compliance and may remove content or restrict accounts if compliance cannot be verified.
